Mohamed Kamarainba Mansaray strongly denounces a recent judgment issued by the High Court of Sierra Leone in favour of Kobi Walker, describing the decision as unlawful, unconstitutional, and a blatant violation of both national and international justice principles.
A document circulating on the social media states that on 30 July 2025, the High Court of Sierra Leone (General Civil Division), presided over by Justice A.T. Ganda (JA), ruled against Mr. Mansaray in a defamation case.
That the court awarded damages of NLe 250,000 and imposed various orders, including a perpetual injunction, despite the fact that Mr. Mansaray was never served with a summons, was never informed of the proceedings, and was never represented in court.
Mr. Mansaray, who is currently residing in the United States, emphasizes that his U.S. residential address was not stated anywhere in the judgment, nor was there any attempt by any court or the plaintiff to serve him in accordance with the laws of Sierra Leone, the principle of natural justice, or international due process standards.
The law clearly states that, ‘the plaintiff must serve the Defendant(Respondent) PERSONALLY and wherein the Defendant is out of the jurisdiction the Plaintiff must seek the leave of the Court to serve out of the Jurisdiction. When the Plaintiff cannot or does not have the Defendant’s address, there are ways to do it, which Kobbi Walker hasn’t done but chose to do this surreptitious means to get a judgment’.
“This judgment is not only illegal; it is a travesty of justice. It violates the very foundation of fair hearing enshrined in our Constitution, in ECOWAS protocols, and in universal human rights law.
No one can lawfully be tried in absentia without proper service or representation in a civil matter,” said Mr. Mansaray.
According to Mr Kamarainba, the so-called judgment directly contravenes Section 23 of the Constitution of Sierra Leone (1991), which guarantees the right to a fair hearing and representation before any civil judgment is passed.
And that it also contravenes the Rules of Natural Justice, particularly audi alteram partem — the right to be heard — which forbids passing judgment against a party without giving them the opportunity to present their case.
Mr. Kamarainba also asserts that the Sierra Leone judiciary is increasingly under the control of corrupt politicians and business figures who use the legal system as a weapon to silence critics and protect their illicit interests.
“The judiciary in Sierra Leone has become a tool for rogue politicians and unscrupulous businessmen like Kobi Walker to pursue personal vendettas. They use courtrooms not for justice but for silencing opponents and protecting unexplained wealth derived from exploiting Sierra Leone’s natural resources,” He noted.
“This so-called judgment is a stain on Sierra Leone’s justice system. It sends a dangerous message to the world that our courts can be hijacked to destroy individuals without giving them a chance to defend themselves. It is against our Constitution, against African and ECOWAS law, and against basic humanity,” Kamarainba concluded.
