High Court Judge, Hon. Justice Cosmotina C. Jarrett of Sexual Offence Model Court No 6, yesterday Tuesday 11th October 2022, remanded Abubakarr Gbla for alleged sexual penetration of an underage school pupils.
Accused Abubakarr Gbla is before the court on three count charges of Sexual penetration of an underage child; contrary to Section 19 of Sexual Offences Act No. 12 of 2012 as repealed and replaced with Section 4 (a) ii of the Sexual Offences Amendment Act of No. 8 of 2019.
According to case files, the accused was alleged on a date unknown between 1st January 2019 and 31st December 2019 in Freetown engaged in an act of sexual penetration of a child under the age of 18 to with 9, 13 and 12 years.
Testifying in court, the 13 years old victim recognized the accused as a neighbour and recalled on the side date.
She narrated that she used to call the accused uncle because he normally give her money.
She told the court that the accursed normally takes her along with her colleagues to school with his ‘Keke’, adding that at one time the accused did not take them to school rather the accused took them to an ‘ataya base’ and bought them food.
The 13 years old victim explained that after eating, the accused took them to an unfinished building and he asked them to remove their uniforms and pants, but they refused.
She said the accused forcefully throw her into a bed in the unfinished building, removed her pant and inserted his penis into her vagiana and abused her with two of her colleague.
She added that after the accused have forcefully penetrated them the accused told them not to inform anyone about what happened to them, threatened to kill them.
She said that after they were sexually abused the accused gave each of them two Thousand Leone old note and took them home.
The 13 years old sexual penetration victim disclosed that one day her colleague’s aunt noticed her condition and asked her what happened with her and she told her colleague’s aunt that the accused that had penetrated her with her colleagues.
She said that the aunt later told her mother about the alleged incident and she told the same story to her mother, adding that after her mother had the story she took her to the Kissy Police Post on Black Hall Road, Kissy and reported the matter. A Police Medical Form was issued for treatment at the Rainbow Centre.
Lawyer Hassan M. Timbo cross examined the victim, which she told the court that the accused had penetrated her many times.
She was asked the distance where the accused use to sexually penetrate her, she could tell the distance.
Justice Cosmotina C. Jarrett adjoined the matter to October 18th 2022.
