Magistrate Shar Kekura of Ross Road Court No.1 has sentenced Mohamed Kanu, a Landlord Mohamed Kanu and Yeabu Conteh, a Landlady to the tenant, Foday Francis Bangura to pay two hundred fifty leone (NLe250) to the state or alternatively faced three months imprisonment at the Male and Female Correctional on Pademba in Freetown.
In his ruling, Magistrate Kekura said the accused were arraigned before the court on two counts charges of conspiracy and malicious damage contrary to section 52 of the Malicious Damage Act of 1861.
He said the brief fact of the matter is that on Wednesday 25, January 2023 at No. 10 Harding Street Rokupa in Wellington, Freetown, Yeabu Conteh and Mohamed Kanu, conspired with unknown persons and maliciously damaged eighteen (18) corrugated zinc sheets a pot of food and others valuables worth seven hundred and ninity leones (NLe790) belonging to the complainant, Foday Francis Bangura.
Magistrate said six prosecution’s witnesses were led by Chief Inspector Isatu Bangura including the Exhibit Clerk, who tendered the various exhibits.
He said the witnesses were cross examined by the Defence Counsel, Randy S. Bangura from Legal Aid Board (LAB) Sierra Leone, adding that due to the accused’s confession statements made at the police station, admitting that they hired and instructed a carpenter to remove the zinc on top of the complainant’s roof, he was convinced that the prosecution had proven her case beyond all reasonable doubt.
The convicts were found guilty as charged.
Being that the Defence Counsel, Randy S. Bangura was not present, no plea mitigation was made.
Magistrate Kekura ordered the convicts to pay two hundred fifty leones (NLe250) to the state or alternatively imprisoned for three months.
Chief Inspector Isatu Bangura was prosecuting the matter.
