Magistrate Alpha Ahamadu Jalloh of the Freetown Magistrate Court No. 4 has called on police prosecutors and lawyers to be always attentive with the law whenever they want to indict an accused for trial.
He noted that it has comes to its realization that both parties make blunder in most of their charges using wrong sections of the law to arraign accused persons in courts, which he described as ‘unfair.’
“We as lawmakers and interpreters of the law should try to research well before we make such kind decisions,” said Magistrate Jalloh.
He continued that the law is not like any ordinary food and as a result police prosecutors and lawyers must really take their time because little mistakes have the potential to make a lawyer or prosecutor loses relevance of his or her matter.
When such situation occurs, you must start all over again which consumes time, resulting to the delay to justice delivery, he admonished.
Such mistakes, he added are not good for the judiciary, as blame is being cast on them, not knowing that such excesses are games played by lawyers and police prosecutors who proffer chargers to court.
Magistrate A. Jalloh made this caution statement whiles presiding over an allegation of fraud matter in which he said should not be fraud but malicious damage of a phone that was prosecuted by Sub-Inspector Kamara. K. S. which was dismissed by the Magistrate due to lacks evidence and improper charges made before the court.
The Magistrate gave a Court Order for the which was in the possession of the police that should be returned to its rightful owner and dismissed the matter.
In another development, a case of one Pa Alimamy Sesay alias White Boy and three others were arrested by the police in Waterloo during a raid conducted at a community called Jorpor Farm, in the Western Rural District, is presently before the court on four count charges, ranging from wounding, wounding with intent, larceny, and conspiracy to commit a felony.
All accused persons were refused bail and remanded at the Male Correctional Center in Freetown for further hearing.
They are before Magistrate Mark Gaybar at the Pademba Road Court in Freetown, while ASP I. S. Mansaray is prosecuting this matter.
