The accused, Momoh Konneh who was arrested on 12th March, 2023 arrested by Detective Sergeant M.G Wallace appeared before Magistrate Sahr Kekura of Ross Road Court No.1 in Freetown for allegedly conspiring with unknown persons to obtained four thousand United States dollars equivalent to one hundred and twenty-two leones (NLe122, 000) pretending that he would facilitate his travelling to Canada knowing same to be false.
Momoh Konneh, 24 was arraigned before the court on two counts charges of conspiracy and obtaining money by false pretences contrary to section 32 (1) of the Larceny Act of 1916.
The police say the accused, on Thursday 19th January 2023 at Tower Hill, in Freetown conspired with unknown persons to defraud Osman Deen of NLe122, 000 pretending that he would facilitate his travelling to Australia knowing same to be false.
The charge sheet furthered that the accused, on the same date and place in Freetown obtained NKe122, 00 from the complainant pretending that he would facilitate his traveling to Australia knowing same to be false.
Led in evidence by Assistant Superintendent of Police (ASP) Osman M. Bangura prosecution witness (PW)3, who also doubles as formal witness Detective Sergeant 5600 Marrah T. S residing at Grafton Barracks attached to the Criminal Investigation Department (CID) at the Regional Ross Road Police Station Harbour, Division in Freetown said he recognised the accused and could 14th January 2023.
He said he was on duty at the said unit, at the Regional Ross Road Police Station they received the matter was investigated by the original investigator brought to the the CID for further investigations. He said the matter was assigned to him for further investigations.
Having gone through the file, he said he found out that there was sufficient evidence against the accused as a matter of fact, he and Detective Inspector Malvin M. G. Wallace charged the accused with the offences of conspiracy to defraud and obtaining money by false pretence contrary to law.
The charged statement of the accused was produced and tendered to form part of the court’s records.
Defence Counsel M. A. Conteh cross examined the witness on behalf of his client.
The accused is still on bail and the matter was adjourned to 20th September 2023 for hearing.
