The Operational Support Division (OSD) Officer, attached to FAWAZ Building Materials store at Kissy Ferry Terminal, Amos J. Lavalie has narrated how he shot Francis Mansaray on his right jaw when he and his co-intruder tries to kill him.
Francis Mansaray is before Magistrate Sahr Kekura of Ross Road Court No.1 for the offences of conspiracy to commit a felony contrary to law, robbery with aggravation contrary to Section 23 (1) (a) of Larceny Act 1916 as Repealed and Replaced by Section 2 of No. 26 of 1971 and assault occasioning actual bodily harm contrary to Section 47 of the Offences against the Persons Act of 1861.
It was alleged that the accused, on Saturday 1st March 2023 at the Sierra Leone Frozen Compound Kissy Terminal Freetown, conspired with unknown persons to commit a felony, to wit robbery with aggravation.
The charge sheet furthered that the accused, on the same date and place in Freetown robbed Amos Junior Lavalie for Trollies worth NLe428 property of Sierra Leone Frozen Company while in custody Amos Junior Lavalie.
Led in his examination in Chief by Sub Inspector Isatu Bangura, the witness police Constable 20756 Amos J Lavalie attached at the OSD, recognized the accused person at the dock in respect of this matter.
He said on Saturday 1st March 2023, he was on duty at FAWAZ Building Materials store Kissy Ferry Terminal, at around three in the morning when he was on patrol when he noticed breakage on the fence. He said he decided to go and found out what is happening and proceedings further he saw the accused holding a knife and stone and another holding an unidentified objection which he later realized was a pistol.
The witness said he tried to halt them when the first accused removed the knife and the other take out a pistol and threatened to kill him.
The police witness said seeing the pistol, he was panicked but put away his fear and shot the first accused at his right jaw, and he fell on the ground whiles the other flee.
Explaining further in his examination in chief, the witness said the co-suspect when trying to fled dropped the pistol. He said he called at the OSD Headquarter.
Upon reaching this stage, the prosecutor Sub Inspector Isatu Bangura called for an adjournment in order for her to have proper conference with her witness. Her application was granted and the Bench adjourned the matter for Monday 12th of June 2023.
