Magistrate Sahr Kekura of Ross Road Court No.1 has recently discharged the matter between the Inspector General of Police and Ajina Mansaray for want of prosecution.
The accused was arraigned before Magistrate Kekura after police investigation for preliminary hearing on seven count charges of conspiracy to commit felony, robbery with aggravation, wounding and assault occasioning to actual bodily harm contrary to Section 47 against the Person’s Act of 1816.
It was alleged by the police on the charge sheet on count one that on Sunday 19th November 2022, at Old Main Motor Road, Deep Eye Water, in the Western Rural District, the accused conspired with other person unknown to commit felony to wit robbery with aggravation.
On count two and, it was alleged that on the same date and place, the accused being arm with a knife, robbed the complainant Binta Bah one Tecno Cammon 17 mobile phone, valued Two Thousand Five Hundred Leones, and robbed Isata Sow, one Tecno Cammon 19 mobile phone and other properties worth Eight Thousand Two Hundred and Fifty Leones.
The police also alleged that on counts four and five that the accused during the incident wounded the complainant.
On counts six and seven, the police stated on the charge sheet that the accused assaulted both complainants thereby causing them actual bodily harm. The accused who has been appeared in court since the inception of the matter run into luck.
Shortly after the matter was mentioned by the court, the Clerk for further hearing, Magistrate Kekura said since the Prosecution Witness Number One testified on the 27th February 2023 to date no other prosecution witness has been led in evidence and the court has taken several adjournment dates at the instance of the prosecution.
He said the accused has been in custody for over four months without further prosecution. Considering the foregoing, Magistrate Sahr Kekura thereby discharged the accused for want of prosecution, pursuant to Section 94 of the Criminal Procedure Act No. 32 of 1965.
