The defence counsel in the state versus Mohamed Samura, and two others alleged murder matter have opened their case after the close of prosecution.
The defence opened their case with examination of the Exhibit Clerk who testified before Magistrate Mark Ngegba of Padempa Road Court No.1 in Freetown.
It was alleged that on the 27th February 2023 Mohamed Samura, Mohamed Lamin Dumbuya and Hardy Momodu Evelyn Jabbie at Woodland Estate in Freetown conspired together with persons unknown allegedly murdered Samuel Abu Bakarr Kargbo alias Wanie.

Issac Kamara attached at CID headquarter some of his duty is to registration all exhibits related to matters that have being investigated. He recalled that on the 27th February Inspector Karim J.B.M. attached at CID handed over one mix coloured baseball hat, one small purse and a piece of stone the same exhibit has been registered against serial number RCE 46/ 2023 since then it has been in the police custody.
The exhibit where tender in court to form part of court records. Defence counsel for the first accused said they will do a written no case submission while the second and third will be testified in court.
In that light the defence opened their case. The second accused person Mohamed Lamin Dumbuya, he said he is a businessman. He that recalled on the 26th February 2023 he was at Saint Edward thanksgiving as an old boy at around 11:30 am. He stated that after the thanksgiving he was out with some friends drinking in his cars around the school till twelve o’clock.
He furthered that he dropped his friend at Lodge and went to Wilberforce to sleep. He narrated and said on the 27th he woke up at around ten o’clock in the morning and at around one o’clock in the afternoon he left for Kambia to see his mother. He said whiles at Kambia he went around the hospital upon his return he saw two police officers standing in the resident of his mother and he break his car and the police officers work closely to him and asked of his name and said to him that they are looking for one Kelvin and they were investigating one case of alleged happened in Freetown. He said that he told them to wait around but they instructed him to lead them in his mother room to search with on warrant.
The accused continued that they did not find anything in the room and they also search in his car with no search warrant and I open the car he said there was a purse sixteenth thousand euro Eight Hundred British Pound Stanley and One Thousand One Hundred United State Dollars and Five Million One Hundred Leones were in the vehicle. He said that officers took records of it and signed that he took such amount.
He said that after giving them the money they arrested him and his Nissan Roke ATX 141 the car was owned his friend Ramatu. He said that since then he did not receive his money from the police.
The defence counsel made an application that the Head of the CID produce the amount in question received from the accused to be made available in court to form part of exhibits in the matter.
Magistrate Ngegba said since the item where took from the second accused he ordered the Head of CID and the prosecution to return the said amount and adjourned the matter to 24th April 2023.
