The presiding Magistrate of Ross Road Court No.1 has sentenced Musa Kanu and Umaru Sesay to a jail term of six month or alternatively pay the fine of Five Hundred Leones to the state.
They are before the court for conspiracy and larceny contrary to Section 2 of the Larceny Act of 1916.
It was alleged on count one that on Thursday 11th May 2023, at Up Gun the accused persons conspired together with other persons unknown to commit a crime to with larceny.
On count two, the police alleged that on the same date and place, both accused steal one blue black Samsung Android mobile phone valued One Thousand Two Hundred New Leones (NLe1,200) belonging to Hawanatu Koroma.
Prosecuted by Assistant Superintendent of Police Osman Mohamed Bangura, both accused pleaded guilty to the charges levied against them.
The file contained a statement of complainant, her witnesses and that of the accused.
Questioning the first accused about the phone, he told Magistrate Sahr Kekura that on the date of the alleged incident complainant was in a vehicle when he snatched the phone from her and gave it to the second accused who fled with it.
He said after he was arrested by passer byers, he tried to retrieve the phone from second accused but to no avail. Second accused informed the Bench that as soon as he received the phone from first accused, he went and sold it.
Having pleaded guilty to the charges and taking into consideration the explanation of the accused persons, Magistrate Sahr Kekura sentenced them to six-months imprisonment or alternatively pay the fine of Five Hundred Leones to the state.
