Thirty years Eustace Harding made his first appearance before the principal Magistrate of the Freetown Magistrate Court no 1 Magistrate Sahr Kekura as he was alleged of conspiring together with other person to obtained over three hundred thousand Leones from Tommy Massaquoi promising to pay back but failed to do so.
Before the charges were put to the accused defense Counsel M. Sheriff made an objection that the charges cannot be put to the accused as he is been brought to court under the wrong law. He said that the accused is been charged with section 13(1) of the larceny act of 1916 which is wrong in law. He said the correct charge should be section 13(a) of the said act.
He therefore apply that the matter be discharged. The prosecutor ASP Ibrahim Mansaray sought for a date to reply to the objection made by defense Counsel. The accused was remanded in as the charges were not yet put before him. The matter comes up on Thursday 18 January, 2024.
The accused was dragged to court on two count charges of conspiracy to defraud contrary to law and obtaining credit under false pretences contrary to section 13 (1) of the larceny act of 1916.
The charge sheet indicated that the accused on a date unknown between 1 and 21 March 2023 at main motor road Congo cross in Freetown, with intent to defraud, conspired with other person unknown to obtain the sum of three hundred and sixty thousand Leones from complainant Tommy Massaquoi.
The charge sheet further that the accused on the same date and place obtained credit to the amount of three hundred and sixty thousand Leones from Tommy Massaquoi by pretending that he will pay him on 29 April 2023 knowing to be false.
