An Appeal Court Judge, Hon Justice M. A. J. Stevens has last Friday 8 September 2023 granted a 30 million Old Leones bail to convict Mohamed Kamarainba Mansaray.
The Judge, in his submission said after a look at Kamarainba’s bail application and the notice of motion dated 6 September 2023, by his defence council.
He informed the court that bail is granted pursuant to section 67 sub sections 2 of the court Acts of 1965.
Justice Stevens read the bail condition that requested the surety should be resident in the Western Area and bail is to be approved by the Deputy Master and Registrar.
Earlier, the convict lawyer, Emmanuel Saffa Abdulai moved a motion that the court should grant Kamarainba a bail on the grounds of his present critical health condition.
Lawyer Alie T. Turay Esq, James Bockarie Esq, Mary Solomon Esq and Emmanuel Saffa Abdulia Esq all for the convict, told the court that a bail is a discretion guided by statute that his client has excellent and winnable law that allows for the court to grant bail on compassionate grounds.
Having listened to the state counsel, Yusuf I. Sesay, Hon Justice M. A. J. Stevens granted a bail on the condition that the convict passport remains with the court and insisted that the surety most be resident in Freetown.
