Pursuant to Rule 90 (3), the Supreme Court of Sierra Leone has in a notice dated 31st May 2023 struck out petitions filed against the 2023 presidential flag-bearer for the main opposition, All Peoples Congress (APC) party, Dr. Mathew Wilson Samura Kamara.
The petitions that questioned Dr. Mathew Wilson Samura Kamara eligibility to contest the upcoming presidential election was filed recently by former Minister of Sport, Paul Kamara and former Ambassador to the United States, Hon. Ambassador Alimamy Coleson Turay for not complying with the Supreme Court rules.
According to the notice, the First and Second Applicants did not comply with Rule 90(1) of the Supreme Court rules, Public Notice No.1 of 1982 and a certificate of non-Compliance having been issued on the 29th of May 2023.
The Originating Notice of Motion filed on 17th May, 2023 by the said Applicants, Paul M. Kamara and Reverend Alimamy Coleson Turay against the Chief Electoral Commissioner who is the 1ST Respondent, the Electoral Commission of Sierra Leone being the 2nd Respondent, Dr. Samura Kamara as 3rd Respondent and the All People’s Congress party as the 4th Respondent is hereby deemed to have been struck out pursuant to Rule 90 (3) of the above mentioned Supreme Court Rules.
It could be recalled that petitions were filed against the 2023 APC flag-bearer, Dr. Samura Kamara at the Supreme Court of Sierra Leone by former minister of sport, Paul Kamara and former Deputy Ambassador to the United States, Rev. Alimamy Coleson Turay in the matter of an application for the construction, interpretation and determination to sections 35 (4) and 76 (1) (D) of the national constitution of Sierra Leone 1991, Act No.6 of 1991 and in the matter of the nomination of the candidacy of the 3RD Respondent (Dr. Samura Kamara) by the Electoral Commission For Sierra Leone: ECSL.
However, the APC presidential hopeful, Dr. Samura Kamara is now qualified to contest the June 24th, 2023, presidential elections therefore making more red and ready to fix the economy after the polls.
